1. INTRODUCTORY PROVISIONS

1.1. These Terms and Conditions for Sellers (hereinafter: Terms) govern the rights and obligations of sellers (hereinafter: Seller) on the online platform Memorabilia Market EU (hereinafter: Platform).

1.2. The platform is operated by Mitja Mugerle (Slovenia).

1.3. The Platform operates as an intermediary marketplace platform and is not the seller of the products listed on the Platform.

1.4. By registering, listing products, or using a seller account, the Seller confirms that they have read, understood, and fully agree to these Terms.

2. PLATFORM STATUS

2.1. The Platform provides technical infrastructure only for:

listing offers,
communication between users,
support in using the system.

2.2. The Platform:

is not the owner of the products,
does not participate in the sales contract,
does not guarantee the success of sales,
does not assume responsibility for the fulfillment of obligations between the Buyer and the Seller.

2.3. The sales contract is always concluded directly between the Seller and the Buyer.

3. REGISTRATION AND SELLER ACCOUNT

3.1. The Seller must have a valid user account with accurate, truthful, and up-to-date information.

3.2. The Platform reserves the right to:

conduct additional identity verification,
request supporting documentation,
reject or terminate a seller account.

3.3. The Seller is solely responsible for the security of their account and all activities carried out through it.

4. PRODUCTS AND LISTINGS

4.1. The Seller guarantees that all listed products are:

original,
legal,
compliant with applicable laws.

4.2. The sale of counterfeit, stolen, or illegal products is strictly prohibited.

4.3. Product descriptions must be:

accurate,
clear,
not misleading.

4.4. Photos must represent the actual product. The use of images from the internet or other platforms is not permitted.

The Platform reserves the right to remove or modify any listing that is misleading, unrealistic, or negatively impacts the quality and trust of the marketplace.

5. PRICES, COMMISSIONS AND PAYMENTS

5.1. The Seller independently determines the selling price of their products.

5.2. The Platform currently does not charge any commission for listing or selling products.

5.3. The Platform reserves the right to introduce commissions in the future, of which users will be informed in advance.

5.4. The Platform acts solely as an intermediary for listing advertisements and does not participate in payment transactions between the Buyer and the Seller. All payments are made directly between users. The Platform is not responsible for any disputes, failed payments, or any issues arising from transactions between users.

The Platform reserves the right to request price adjustments or remove listings that significantly deviate from the market value without justified reason.

6. SHIPPING AND DELIVERY

6.1. The Seller is fully responsible for:

timely shipment,
proper packaging,
accurate delivery information.

6.2. All agreements regarding delivery method, costs, and shipping time are arranged directly between the Buyer and the Seller.

6.3. The Platform does not participate in the organization of delivery and is not responsible for any delays, loss of shipments, or other delivery-related issues arising from agreements between the Buyer and the Seller.

7. LIABILITY AND DISPUTES

7.1. The Seller is fully responsible for:

product compliance,
communication with the Buyer,
fulfillment of the sales contract.

7.2. The Platform is not responsible for:

disputes between buyers and sellers,
non-delivery,
financial losses.

7.3. The Platform reserves the right to intervene in case of violations of these Terms.

The Seller is fully responsible for setting fair and reasonable prices and for ensuring that listings do not mislead buyers.

8. VIOLATIONS AND SANCTIONS

8.1. In case of violations, the Platform may:

remove a product,
temporarily restrict an account,
permanently disable access,
withhold payouts.

8.2. The decision of the Platform is final.

The Platform may take action against listings that harm the credibility or integrity of the marketplace, including listings with unrealistic pricing or misleading information.

9. CHANGES TO TERMS

9.1. The Platform reserves the right to modify these Terms.
