1. Introduction

These Terms of Service govern the use of the online platform Memorabilia Market EU, operated by Mitja Mugerle (Slovenia).

The Platform enables users to list, buy, and sell collectible items, such as sports cards, sports memorabilia, and other related items.

2. Definitions

User: any person using the platform
Seller: a user who lists items for sale
Buyer: a user who purchases items
Item: a product listed by the seller on the platform

3. Role of the Platform

Memorabilia Market EU operates solely as a technical intermediary that connects buyers and sellers.

The Platform is not the owner of the listed items and does not participate in transactions between users.

All agreements are concluded directly between the buyer and the seller.

4. Nature of the Platform (Important)

Memorabilia Market EU is an intermediary marketplace platform and is not the seller of the listed items.

This means:

the platform does not sell items,
the platform does not guarantee the authenticity, quality, or description of items,
the platform does not guarantee delivery or the condition of shipments,
the platform does not process payments and does not hold funds.

Contractual Relationship

Any agreement is made directly between the buyer and the seller.
The Platform is not involved in the transaction and does not assume any responsibility related to it.

The Platform provides only technical infrastructure for:

support for using the platform.

listing items,

communication between users,

5. Rules for Sellers

The seller agrees that:

they publish truthful and up-to-date photos and descriptions of items,
they do not list counterfeit or prohibited items,
they respect buyers and respond to inquiries,
they deliver the item within the agreed timeframe,
they comply with applicable laws in their country.

Prohibited actions:

listing counterfeit items,
fraudulent behavior,
misleading buyers,
using images that do not belong to them or are misleading.

In case of violations, the Platform may:

permanently disable access for the seller.

remove the item,

temporarily restrict the account,

6. Rules for Buyers

The buyer agrees that:

they do not misuse the system or open false disputes.

they carefully review the item description before purchasing,

they contact the seller for additional information if needed,

they complete the transaction directly with the seller under agreed terms,

they communicate respectfully with the seller,

7. Prohibited Items

The following items are prohibited on the Platform:

counterfeit or stolen items,
items with illegal content,
items that infringe copyright or other rights,
dangerous or legally prohibited items.

The Platform reserves the right to remove such items without prior notice.

8. Platform Liability

The Platform shall not be liable for:

– actions or omissions of buyers or sellers,
– delays or issues related to delivery,
– inaccurate or misleading item descriptions,
– damage or loss of items,
– financial or payment-related issues between users.

The Platform provides its services “as is” and without warranties of any kind.

The liability of the Platform is limited to the maximum extent permitted by applicable law.

The Platform shall not be liable for any financial loss resulting from transactions conducted between users.

9. Dispute Resolution

Disputes are resolved:

1. directly between the buyer and the seller,

2. if necessary, with the assistance of platform support:

The Platform may assist in communication but does not act as a mediator, arbitrator, or decision-maker in disputes between users.

The Platform does not guarantee the outcome of any dispute and does not assume responsibility for dispute resolution between users.

10. Limitation or Account Termination

The Platform may limit or terminate a user account in the following cases:

repeated disputes or misuse of the system.

violation of these Terms,

sale of counterfeit items,

fraud or abuse,

inappropriate or harmful behavior,

11. Changes to Terms

The Platform reserves the right to modify these Terms at any time.
